1. Introduction
Welcome to London Mobility Scooters Rental. This document outlines the Terms and Conditions (hereinafter referred to as the "Terms") under which London Mobility Scooters Rental ("we," "us," or "our") offers you access to our services. Our services include the rental of mobility scooters to individuals who require assistance with mobility.
By registering with us, initiating a booking, or utilizing any of our services, you ("User," "you," or "your") acknowledge and agree to be legally bound by these Terms, which form a binding legal agreement between you and London Mobility Scooters Rental. Please read these Terms carefully before proceeding. If you do not agree with any part of these Terms, you must not use our services.
2. Definitions
In these Terms, the following terms shall have the meanings set out below:
- "Service" refers to any and all mobility scooter rental services provided by us as detailed on our website and through our customer service.
- "Scooter" refers to any mobility scooter provided by us for rental purposes.
- "User," "Renter," "Customer" refers to any individual or entity who rents a scooter or inquires about scooter rental services from us.
- "Booking" refers to the act of reserving a scooter through our online platform, over the phone, or in-person at one of our locations.
- "Rental Period" refers to the duration for which the scooter is rented by the User, starting from the time the scooter is picked up by the User until the time it is returned.
- "Personal Information" refers to any information that identifies an individual, such as name, address, email address, and phone number.
3. Eligibility Requirements
To use our Service, Users must meet the following criteria:
- Be at least 18 years of age.
- Hold a valid, government-issued photo identification.
- Provide a valid credit or debit card or other approved payment method for the deposit and rental charges.
- Agree to comply fully with these Terms and any additional terms presented at the time of booking or scooter collection. Users must ensure that all information provided during the registration and booking process is accurate, complete, and up-to-date. Failure to comply with these eligibility requirements may result in denial of service or termination of the rental agreement.
4. Account Registration and Management
- Account Creation: Users must create an account through our online platform to access and use our Services. During registration, Users must provide truthful, accurate, and complete information as prompted by the registration forms and must update such information as necessary to maintain its accuracy.
- Account Responsibilities: Users are responsible for maintaining the confidentiality of their account login information and are fully responsible for all activities that occur under their account. Users agree to immediately notify us of any unauthorized use, or suspected unauthorized use, of their account or any other breach of security.
- Account Updates: Users are obligated to update their account information to reflect any changes such as a new billing address or phone number. We are not responsible for any issues that arise due to outdated or incorrect account information.
5. Rental Terms
- Booking Confirmation: Upon making a reservation, Users will receive a booking confirmation via email or SMS, which includes the rental period, the specific scooter model reserved, and the total cost of the rental.
- Rental Agreement: Prior to receiving the scooter, Users must sign a detailed rental agreement that specifies the terms of the rental, use restrictions, and obligations during the rental period. This agreement must be signed in-person or agreed to through a digital platform before the scooter is released to the User.
- Extension of Rental Period: Requests for extensions must be made at least 24 hours before the end of the initial rental period and are subject to scooter availability and additional payment. Extensions are not guaranteed and depend on subsequent bookings and availability.
6. Pricing and Payments
· Fees and Charges: Our pricing structure is comprehensive and will be clearly itemized in the rental agreement and on our website. It includes daily rental rates, optional insurance fees, deposit requirements, and any penalties for late returns or damages.
· Payment Methods: We accept various forms of payment including major credit cards, debit cards, GoCardless, and other approved digital payment methods. Full payment, including any security deposit, is required at the time of booking.
· Deposits: A refundable security deposit is required for all rentals. This deposit covers potential damages, loss, or excessive wear and tear of the scooter. The conditions for deposit deductions and returns will be clearly outlined in the rental agreement. Deposits are typically returned within a specified timeframe after the scooter is returned and inspected.
7. Deposit Requirements
- Deposit Amount: The specific amount required for the deposit will be determined based on the model of the scooter rented and the duration of the rental. This amount will be clearly communicated to you at the time of booking.
- Conditions for Deposit Return: The deposit will be fully refundable upon the return of the scooter in the same condition as it was rented, subject to an inspection by our staff. Any damages or necessary repairs will be documented and may result in deductions from the deposit. We will provide a detailed receipt of any deductions made.
- Dispute Resolution for Deposits: In the event of a dispute regarding deposit deductions, you have the right to receive a detailed explanation of the charges and may contest them through our designated dispute resolution process outlined in Section 22.
- Security Monitoring: In addition to the deposit, we may equip scooters with GPS tracking or other security devices to monitor their location during the rental period. This is to ensure the safety of the equipment and compliance with our usage policies.
8. Use of Scooters
- Permitted Uses: The scooter may only be used for personal transportation within the agreed-upon areas as specified at the time of rental. Use of the scooter for commercial purposes, racing, stunt riding, or any illegal activities is strictly prohibited.
- Proper Handling: Users must operate the scooter in a manner that is consistent with its intended use and comply with all applicable laws and regulations, including road safety laws. Users are expected to handle the scooter with care to avoid damage and undue wear and tear.
- Restrictions on Modification: No alterations, modifications, or additions may be made to the scooter without our prior written consent.
· Geo-Fencing: Scooters must be operated within designated areas as outlined at the time of rental. Our scooters are equipped with geo-fencing technology that will alert us if the scooter is taken outside of the permitted area, and may automatically limit the scooter's operation.
· Compliance with Traffic Laws: Users must adhere to all local traffic laws and regulations while operating the scooter. Non-compliance with traffic laws can result in fines, legal action, and termination of the rental agreement.
· Safety Gear: Users are strongly encouraged to wear safety gear, such as helmets and reflective clothing, while operating the scooter. In some areas, such safety gear may be legally required.
· Immediate Notification Required: In case of theft or loss of the scooter, you must immediately notify us and the local authorities. Failure to report the theft or loss promptly may result in liability for any damages or misuse occurring after the scooter was stolen or lost.
9. Prohibited Activities
- List of Prohibited Uses: You may not use the scooter in any way that could be considered unsafe, illegal, or in violation of the terms of the rental agreement. Prohibited activities include, but are not limited to, towing/towing other objects, carrying more than one person, and riding on prohibited or unsafe terrain.
- Consequences of Prohibited Use: Engaging in prohibited activities may result in immediate termination of the rental agreement, forfeiture of the security deposit, and potential legal action if damages occur as a result of such activities.
10. Scooter Maintenance and Responsibility
- User Maintenance Responsibilities: You are responsible for the basic maintenance of the scooter during the rental period, including ensuring it is charged, clean, and stored securely when not in use.
- Reporting Issues: Any mechanical issues or concerns must be reported to us immediately. Continued use of a scooter after an issue has been identified may lead to greater damage and increased liability on your part.
- Company Maintenance: We commit to providing scooters that are in good working condition and have undergone thorough pre-rental inspections to ensure safety and functionality.
- Damage Inspection: Upon return, the scooter will undergo a thorough inspection to assess any damage or misuse. If the scooter is found to be significantly damaged or altered, repair costs will be charged to your account, and may exceed the initial deposit amount.
11. Damage and Loss
- Responsibility for Damage: You are responsible for any damage to the scooter that occurs during the rental period, except for normal wear and tear. A detailed inspection will be conducted when the scooter is returned, and any damages will be assessed and charged accordingly.
- Loss or Theft: In the event of a lost or stolen scooter, you are required to file a police report and notify us within 24 hours of the incident. You may be liable for the replacement cost of the scooter if negligence is found.
12. Breakdowns and Mechanical Failures
- Reporting Failures: You are required to report any breakdowns or mechanical failures immediately to our customer service team. Do not attempt repairs or modifications on your own.
- Service Response: We will provide prompt assistance to address the breakdown. If the scooter cannot be repaired promptly, we will supply a replacement scooter subject to availability.
- No Fault Breakdowns: If a breakdown occurs through no fault of the user and affects the ability to use the scooter, we will adjust the rental charges accordingly for the time the scooter was not usable.
13. Accidents and Incident Reporting
- Immediate Notification: In the event of an accident involving the scooter, you must notify us immediately, providing a detailed account of the incident, including any damage to the scooter or property, or injuries to persons involved.
- Documentation Required: You are required to provide names and contact information of all parties involved, a copy of any police report filed, photographs of the scene and the damage, and any other relevant information.
- Cooperation with Investigations: You agree to cooperate fully with us and our insurance providers in the investigation and settlement of any claims arising from the accident.
14. Refund and Cancellation Policy

- Early Returns: Users returning the scooter before the end of the rental period are not entitled to a refund for the unused portion of the rental unless previously agreed upon in special circumstances.
15. Privacy Policy
- Collection of Personal Information: We collect personal information necessary for the registration process and the management of your rental. This may include your name, contact details, payment information, and other information required by law.
- Use of Information: Your personal information is used exclusively for business purposes, including managing bookings, processing payments, and communicating with you about your rental or promotions if opted-in.
- Security Measures: We implement strong security measures to protect your personal information from unauthorized access, alteration, or destruction. Our data protection practices comply with GDPR and other relevant legislation.
16. Data Sharing
- Third-Party Sharing: We may share your personal data with third-party service providers who perform services on our behalf, such as payment processing and customer service, under strict confidentiality agreements.
- Legal Compliance: We may disclose personal information if required by law, such as in response to a court order or a legal investigation.
- No Selling of Data: We do not sell your personal information to third parties for their marketing purposes without your explicit consent.
17. Intellectual Property
- Ownership: All content on our website, including text, graphics, logos, images, and software, is the property of London Mobility Scooters Rental or its content suppliers and protected by UK and international copyright and intellectual property laws.
- Use Restrictions: You may not reproduce, modify, distribute, transmit, or use the content of our website for commercial purposes without obtaining prior written consent from us.
- Trademark Information: The trademarks and logos displayed on our website are registered and unregistered trademarks of London Mobility Scooters Rental. Nothing in these Terms grants you a license to use any trademark without the prior written permission of the trademark owner.

19. Modifications to Terms and Services
- Notification of Changes: We reserve the right to modify these Terms and any aspect of our Service at any time. We will notify you of any changes by posting the revised Terms on our website or by direct communication. Your continued use of the Service after such modifications have been made constitutes your acceptance of such changes.
- Service Adjustments: Modifications to our Service may include changes in pricing, introduction of new service offerings, or discontinuation of existing services. We will provide reasonable notice of any significant changes to ensure you can make informed decisions about your continued use of our services.
20. Termination of Service
- By User: You may terminate your use of our Service at any time by closing your account, discontinuing your use of the Service, or providing us with written notice of termination.
- By Company: We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.
- Effects of Termination: Termination of service may involve deletion of your account information, discontinuation of your access to the Service, and forfeiture of any pending transactions.
21. Dispute Resolution
- Initial Dispute Handling: In the event of a dispute, users are encouraged to contact our customer service team directly to seek a resolution.
- Mediation and Arbitration: If the dispute cannot be resolved through direct communication, the parties agree to submit the dispute to mediation, followed by binding arbitration, if necessary, under the rules of the Arbitration Association of the UK.
- Jurisdiction: For disputes not subject to arbitration, legal proceedings shall be conducted in the courts located in London, United Kingdom, and parties consent to the exclusive jurisdiction of those courts.
22. Governing Law
- Jurisdictional Compliance: These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
- Consistency with Local Laws: In the case where local consumer laws impose mandatory conditions that provide greater protection to you than the conditions stated here, such local laws will supersede these Terms in respect to the provision of those protections.
23. Severability and Waiver
- Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. Such invalidity or unenforceability will not invalidate or render unenforceable any other portion of these Terms.
- Waiver: The failure to enforce any right or provision of these Terms will not be considered a waiver of those rights unless acknowledged and agreed to by us in writing.

- Force Majeure: We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, but not limited to, mechanical, electronic or communications failure or degradation (including "line-noise" interference).
- Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms, at our sole discretion, without restriction.
- Entire Agreement: These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
- Notification Procedures: We reserve the right to determine the form and means of providing notifications to our users, and you agree to receive legal notices electronically if we so choose. Notifications may be given via email or through posting on our website.
